Rule 39-227.1. Post Trial Relief

 

            39-227.1.1.  Post-trial Motions shall be filed within the time provided for by the Pennsylvania Rules of Civil Procedure.

 

            39-227.1.2.  Reasons for a new trial granted on after-discovered evidence must be supported by verification, filed with the reasons, stating the after-discovery, the names of the witnesses and the substance of their expected testimony, and the party's belief in its sufficiency to change the verdict; otherwise they will be disregarded.  The facts on which the application is based must be established by deposition taken and filed before Argument on the Motion.

 

            39-227.1.3.  The moving party in all Post-trial and Post-hearing Motions or Petitions should, if Argument thereon is with reference to the testimony, include a request for transcription of the testimony or such part thereof as it may be agreed upon by the parties to have transcribed and in such case the Order shall include a direction to the Court Reporter for transcription thereof within a specified time.  A copy of the Court's Order shall be served forthwith upon the Court Reporter by ordinary mail by the moving party.

 

 

 

 


Rule 39-227.4.  Entry of Judgment upon a Praecipe of a Party

 

            In all cases where Rules have been taken, the neglect of which entitled the party to judgment, the same may be entered by the Prothonotary after expiration of the time within which the respondent in the Rule is required to answer.  The judgment may be taken on Praecipe from a party or his attorney, which Praecipe shall set forth the nature of the default, and when it is for default of plea, shall contain proof of service of the Notice to Plead.
